AFFIDAVIT <br />STATE OF COLORADO § <br />§ KNOW ALL MEN BY THESE PRESENTS: <br />COUNTY OF &r pq cll- § <br />BEFORE ME, the undersigned authority, personally appeared Robert Clark, being of lawful age, who <br />resides in Denver, Colorado, who after me being duly sworn, on his oath, deposes and says the following: <br />I, Robert Clark, am above the age of twenty -one (2 1) and am a professional transcriptionist with over 10 years of <br />experience. Acting in my capacity as a transcriptionist, I download and recorded an audio file from the Colorado <br />Public Radio web site dated August 28, 2003 of an interview on the Colorado Matters show, which aired on that <br />date. The host of the show was Dan Drayer and his guest was Colorado Supreme Court Justice Gregory Hobbs. <br />At the request of my clients, attorneys Cindy Covell and Gib Marchand, I listened to the recording and transcribed <br />only that portion of the interview in which Justice Hobbs discusses why he recused himself from participating in a <br />City of Golden case concerning in -stream flow water rights and kayak issues. This portion of the interview lasted <br />approximately 5 (five) minutes, starting approximately 19 minutes into the recording and ending approximately 24 <br />minutes into the 25 minute and 52 second recording. <br />The attached transcript, entitled "Colorado Public Radio - Colorado Matters Show - Host Dan Drayer - August 28, <br />2003 - Excerpt of Interview with Colorado Supreme Court Justice Gregory Hobbs," is a true, correct, complete and <br />verbatim documentation of what was said. <br />The above statements are true and correct.
