The Operating Commiltcc: may choose to crcatc <br />subcommittees to focus on certain subject azeas if it determincs that doing so <br />is advisable. <br />I� ii It is anticipated lhat on most issues the Operating Committee w-ill be able to <br />reach a consensus, and such detemunations will be ratified by DNR and <br />SPWRAP. !n the event the Operaiing Committee is unable to reach x <br />I� conscnsus, appropriate membcrs of the Operating Committee will prescnt the <br />competing so(utions or determinations to thc Director of the BNR and tite <br />SPWRA.P board. DNR and SPWRAP will then agree on a resoluGon of the <br />I� issuc. Through this proccdure, ultimately, all decisions will he made by <br />cc�nsensus. <br />b. Water Oblieations Associated With The Colorado Proeram. The proposed <br />prograni to re-time or rc-rc�ulate llows in the lower South Plattc River is an <br />important eleme�tt of the PRRIP within Colorado. The Parlies will agree upon a <br />plan far meeting Golorado's re-regulation obligations (the "Water Projects Plan" <br />forn�erly known as ihe "Tamarack Plan"} baseci on rccqmmenciations of the <br />Operating Committce. The Parties acknowledge that thc Water Projects Plan may <br />evoh�c over the course of the First Inerement, nevertheless, thc Parties will seek to <br />have an initial Watcr Pmjects Plan in place by January 1, 20b8. The Operating <br />Committce wiil also devetop an appropriate mcans of documenting tl�e Parties <br />a�m,�cment on the inilial Water Projects Plan, including arnendments thercto. <br />Purther agrecmettts betwecn DNR or sub-agencies wid�in DNR, SPWRAP and <br />perhaps 3hird parties may be entcred to implement thc Water Projects Plan. <br />One such anticipated further agreement involves the Colorado Division of <br />Wildlife ("CDOW") pertaining to fhe use of the Tamarack Ranch State <br />Wildlife Area and thc Aony Express State Wildlife Area, along with ccrtuin <br />wells and related recharge facili�ics locared thereon.
