WifEREAS, Colorado may not havc adequau fands available to meet the enrlre cash conuibution and other expenditures myuired by the PRRIP; and, WHEREAS, water asers within Colorudo formed SPWRAP for the purposcs of: 1) assisring in thc operating and administering thc Colorado Pragram; and, 2) raising funds to assist in mecdng Colorado's monetary obiigaaons under thc PRRIP; and, 1�'HEREAS, it is appropriate for water users in the South Plattc River Basin, thtough SPWRAP, to work as a panner with DNR in the management of the Colorado Progam and the diroction of PRRIP; and, WHEREAS, the partnership between SPWI2AP and DNR may include sharing some of the costs associated with ffie PRRIP: and, WHERBAS, there erc Species of Special Concern within the Plattc River basin, which have not yet been listed xs encfangered or tttreatened under the ESA, and re-reguladan of water within Colorado may pmvicle habitat enhancements for such Species of Special Concem; and, WTiEREAS, DNR and SPVJRAP desire to establish, to thc extent possibie, how PRRIP obligadons wiA be met, and how dcxisions relating thereto will be made: NOW THEREFORE, the Parties heceby agree as follows: � 1. Temu This MoA shall remain in effect un61 the earlier of the foilowing: a) the PRRIP is temunated; b) the end of the "First Increment" of the PRRIP, including extensions of the First TncremenY; c) it is superceded by a subsequent written � agreement between DNR and SPWRAP addressing the subject matter of this agreement; or, d) performance by either Party becomes impossible, 2. Performance of Colorado's Obli tlons. DNR and SPWRAP agree to cooperate with regard to the PRRIP as set forth below, in order to streazniine the acavities associatcd with the PRRIP as described herein. This MoA dces not in any way affect, changc, or madify ihe auchorizations that are exclusively and explicitly reserved for tha signatories in tfie PRR1P. a. Operatin¢ Comminee. The Parties acknowicdge that many of the decisions required for implementation of the PRRIP cannot be mxde at this time, and will require un ongoing process of evaluation. The Parties agree to create a Operating Commictee to formulate r�ommendations upon which DNR and SPWRAP can joint(y reuch decisions: i The Operating Committee will be composed of persons made available by the State and SPWRAP.
