canal, together with the water of Forked Tongue Creek, as <br />heretofore appropriated or hereafter appropriated and used by means <br />of said canal. <br />Said Company shall have the power to demand, collect and <br />receive assessments in cash for the expense of delivery of water <br />and maintenance of the ditch prior to the delivery of said water, <br />and to shut off the supply of water from such stockholders as do <br />not pay such assessments as may be called for at a time certain to <br />be f xed by the Board of Directors, not less, however, than thirty <br />days after notice has been given to such stockholders requiring <br />them to make such payment to the Secretary of said Company. The <br />said Company, by its Board of Directors, may prorate the supply of <br />water that may be running from time to time in said ditch or <br />available for' distribution therefrom by time as well as by <br />quantity, and may require water to be divided ratably upon the <br />entire number of shares of outstanding and issued stock in said <br />Company and not in accordance with the number of shares that may <br />require a supply of water for any irrigation season. Each of the <br />shareholders of said Company by purchasing and accepting shares of <br />stock in said Company agree that all present and future <br />appr priations of water made by such shareholders shall be made for <br />the se and benefit of said Company and shall be merged into and <br />beco e a part of the property of said Company, and that each share <br />5 <br />
