pool. The construction will be postponed while water is released in this manner. The <br />remainder of the construction will take place in the Fall of 2003, after the diversions are <br />completed. <br />PERMITTING AND RIGHTS OF WAY <br />All of the channel and associated structures will be constructed on land owned by <br />the Company. Access to the construction areas will be across Company- owned land or <br />through existing easement corridors. The diversion dikes have been located to provide <br />a minimum set -back distance of 50 feet from the property lines. <br />The project has been evaluated to determine whether Section 404 permitting will <br />be required. Mr. Van A. Truan, a Regulatory Specialist from the Albuquerque District, <br />Corps of Engineers, has reviewed the plans and has made a site visit to the project area. <br />Steffens and Associates, Inc. evaluated potential wetland areas at the site for the <br />purpose of a jurisdictional determination (JD). Soil, hydrology, and vegetation were <br />observed at three locations (shown on Figure 3). Cattails (Typha latifolia) and Salt <br />Cedar (Tamarix pentandra) are common near the high - waterline of the reservoir. <br />However, the conclusion from the wetland evaluation is that Hydric soils are absent, that <br />no jurisdictional Waters of the United States will be affected by the project and that the <br />project also meets the conditions for an agricultural exclusion. Therefore, no permits will <br />be necessary under Section 404 of the Clean Water Act. Mr. Truan will be providing a <br />letter to the Company to confirm that conclusion. <br />INSTITUTIONAL CONSIDERATIONS <br />Entities that are, or may be, involved in the design, construction, and financing of <br />the project include: <br />• The Lake Meredith Reservoir Company -- financing, construction, and project <br />management <br />• Steffens and Associates, Inc. -- design engineering and project coordination <br />• Kumar and Associates, Inc. -- geotechnical engineering and geology consultation <br />• Pate Construction Co., Inc. -- construction <br />• Colorado Water Conservation Board (CWCB) -- financing. <br />• First National Bank of Ordway -- financing. <br />• The Colorado Division of Wildlife -- cooperative design /construction of fish screens <br />Lake Meredith Res.
