B. Is reasonably expected to benefit the people in the area where the operation will be <br />conducted § 36- 20- 112(3)(b), C.R.S. (2010). <br />C. Is scientifically and technically feasible § 36- 20- 112(3)(c), C.R.S. (2010). <br />D. Does not involve a high degree of risk of substantial harm to land, people, health, <br />safety, water rights or the environment § 36- 20- 112(3)(e), C.R.S. (2010). <br />E. Includes adequate safeguards to prevent substantial damages to land property, water <br />rights, people, health, or the environment § 36- 20- 112(3)(f), C.R.S. (2010). <br />F. Will not adversely affect another weather modification project § 36- 20- 112(3)(g), <br />C.R.S. (2010). <br />G. Is designed to minimize risk and maximize economic benefits to the residents of the <br />area. § 36- 20- 112(3)(h), C.R.S. (2010). <br />FINAL DECISION <br />The proposed program meets the requirements for a weather modification permit in section 36 -20 -112. It <br />is hereby determined that the permit is recommended for approval to the CWCB Director with the <br />following conditions, which will be more fully described in the permit itself. <br />1. The permit shall be limited to 16 ground based generators for the purpose of augmenting snow for <br />enhanced snowpack and runoff during the time periods specified in the permit. Extensions of <br />operational time periods can be requested in writing to the CWCB, but approval will be based on <br />snowpack and avalanche suspension criteria and other conditions in the target area and/or <br />downstream. <br />2. Said permit shall be for the period from November 1 through April 30, 2011 with conditional <br />approval given for future operations for the five month period of November 1 through April 30 in <br />the years 2010- 2011, 2011 -2012, 2012 -2013, 2013 -2014, 2014 -2015, 2015 -2016, 2016 -2017, <br />2017 -2018, 2018 -2019, and 2019 -2020 based on adherence to: state statutes, coordination with the <br />CWCB on suspension criteria, liability insurance requirements, and annual reporting to the <br />CWCB. The permit will expire on April 30, 2020. <br />3. The person in control of the program must maintain a high level of coordination by consulting <br />with and informing federal and state agencies, local governments, and private entities listed under <br />the terms and conditions of the permit regarding operation of the program. <br />4. Snowpack snow water equivalent suspension criteria at SNOTEL sites will be posted daily on the <br />internet by the NRCS Snow Survey Program in Colorado on a daily basis from December 15 <br />through April 30 every year. This data will be used to suspend operations in time periods when <br />snowpack exceeds levels that are within the natural variability of the local climate. SNOTEL sites <br />that exceed suspension criteria in or near the target area will not suspend all operations within the <br />permit but at a minimum will suspend operations at generator locations thought to reasonably be <br />affecting areas where snowpack suspension criteria is exceeded. <br />7 <br />
