36. Public hearing statement: The Valley was the #2 choice for clear skies and observatory that he put <br />in Flagstaff and a good place for an observatory. Right now the Valley is being courted by solar. <br />It is too bad that we would let any precipitation go by. <br />37. Public hearing statement: Jim Swanson Highway 285 and Road G and started riding ditch for Rio <br />Grande canal in 1981. I also ranch and have cattle at La Garita and Del Norte. There is a change. <br />The storms did build up from Tracy canon to the south part of La Garita Creek. Now I am the <br />water commissioner for north end of the Valley. By tracking our records it is easy to see we have <br />had less precipitation. This was known as a hard place to get your hay put up. This was before the <br />sprinklers. So as a whole I think every single think man has done has pretty much fouled it up. <br />We have a pretty poor job of managing our natural resources.I have nothing against these people <br />I would love to have your hail. Maybe it's a little something of the whole picture. Jim asked <br />where the right to come from to modify the weather. Look at the percent of snowpack in this area <br />for compared to the other basins. We don't have too much of that. How long is this going to go <br />on before. <br />38. Public hearing statement: Will Stenzel of the Attorney General's Office said he a lot of the work <br />is on water court cases. There is a general understanding that things are changing. The weather <br />modification program is based on the state goals to appropriate the water in the skies and more so <br />to regulate private efforts to affect that appropriation. The people's right to appropriate the <br />water's of the state for the peoples. This stems from the old homesteading laws to appropriate the <br />lands into the public domain. The state's obligation to regulate these activities to protect others <br />from nuisance and essentially become a regulatory regime. That is the purpose of these hearings. <br />39. Pubic hearing statement: Virginia Sutherland. Winter modification isn't interested in protecting <br />the environment. The bulk of proof seems to be on the victims. I think there needs to be a <br />moratorium, on some of the weather modification. I think the State of Colorado and Water <br />Conservation Board is handling something above their legality. <br />40. Public hearing statement: Pam Randal wants the CWCB to deny the permit because the <br />precipitation is so low we can't afford to have any moisture pass over us that my drop here. <br />41. Public hearing statement: William Alexander Hoffner I agree with most of the comments made. I <br />farm for a living and am self employed. I have been hailed on several times. This forty five <br />minutes last year is very accurate. The storms start up behind our house. There was a major storm <br />last year. Sometimes we will get an upslope. The breeze starting coming after using the hail <br />cannons. In this particular storm we could hear the cannons. You were pretty intense in 2007 and <br />2008 with operations the minute you could hear cannons the rain stopped. I think even with her <br />own comment she realizes she is making an effect to the cloud. I don't think they should be <br />allowed to get a permit. <br />42. Public hearing statement: I have videoed it and put in the presentation the clouds don't break up <br />and float away. I don't observe that when running the hail cannons. I don't see the clouds <br />change. I don't agree that we are dispersing the clouds. It's a noise maker that is helping the ice <br />not nucleate. <br />43. Public hearing statement: Thad Eglert its likely break bigger droplets into smaller droplets and I <br />really don't think there has been enough science to say yes or no. <br />7 <br />
