State.of Colorado <br />Weather Modification Permit <br />Permit No. 2011 -02 <br />PERMITTEE: Michael D. Jones <br />Southern Colorado Farms, LLC. <br />55 North Torres Street <br />Center, Colorado 81125 <br />PERMITTED PROJECT: Commercial operation for ten ground -based hail cannons in and near <br />the Town of Center, Saguache County. The objective of the weather <br />modification operation is to decrease the frequency and severity of <br />summer hail events associated with summer storm clouds, and to <br />benefit agriculture and the local economy, namely a major lettuce, <br />spinach, and carrot farm. <br />PERIOD OF PERMIT: Final approval of a permit pursuant to the Weather Modification Act of <br />1972, as amended and renewed ( "Act "), for five years pursuant to <br />section 36 -20- 114(2), C.R.S. (2010) and the Colorado Weather <br />Modification Rules and Regulations, 2 CCR 401 -1 ( "Rules ") B(4), <br />subject to annual review and renewal ( "Permit "). The Permit expires <br />on September 15, 2015. <br />TERMS AND CONDITIONS <br />Southern Colorado Farms ( "SCF ") shall conduct its weather modification operation in accordance with the <br />Act and the Rules, as they may be amended, and the following terms and conditions: <br />1. SCF's weather modification operation is limited to June 15 to September 15. <br />2. SCF shall conduct the operation in accordance with SCF's operational plan submitted to the CWCB, <br />except as provided herein. <br />3. Michael D. Jones is the designated operator of the weather modification operation, and shall oversee <br />the operation, including when and how long to operate the hail cannons. <br />4. The target area of the weather modification operation is in and near the Town of Center, Saguache <br />County, including portions of Sections 3, 10, 15, 16, 17 and 20, all in Township 41, North Range 9 of <br />East New Mexico Principal Meridian ( "ENMPM "), Sections 25 and 36, in Township 41 North, <br />
