State under the terms of this agreement Except for the provision of services by
NCWCD personnel as described in paragraph 1 A above, the NCWCD shall not
be required to expend funds or resources in the performance of this agreement
except for the funds provided by the State under the terms of this agreement
C Coordinate and cooperate with the State as necessary, or when requested by the State,
before, during, and after project delivery
D Provide reports to the State as requested by the Project Leader by December 31,
1999, and September 30, 2000 and every three months thereafter if the contract is
extended, with a final report due upon completion of the project work Such reports
shall indicate whether the projects are on schedule, if any projects have been
modified, and the nature of the modifications, any changes in the distribution of

shall be reasonably requested by the Project Leader
E Maintain a complete file of all records, documents, communications, and other
written materials which pertain to the completion of the projects and the delivery of
services under this contract, including but not limited to receipt and expenditure of
funds and its provision of services, and shall maintain such records for a period of
three (3) years after the date of termination of this contract or final payment
hereunder, whichever is later
F When procuring goods and services from third persons in connection with the
performance of this contract, comply to the extent practicable with the requirements
of the Colorado Procurement Code and regulations and rules promulgated
thereunder Reference Articles 101 through 112 of Title 24, C R S , and rules
promulgated thereunder (1 C C R 101 -9), including requiring such third persons to
secure and provide evidence of having secured performance bonds for any capital
construction in excess of fifty thousand dollars (References Section 38 -26 -106,
CRS)
2 The State Shall
A Provide up to $209,000 00 in cost sharing toward the projects described in Exhibit
A
B Review and approve, as appropriate, engineering designs submitted by NCWCD for
development and enhancement at the Tamarack Ranch S WA and for any additional
or substitute sites which may be approved for development and enhancement
pursuant to this contract
C Review and approve requests, with justification, to modify the design or cost
