B Review and approve, as appropriate, engineering designs submitted by NCWCD for development and enhancement at the Tamarack SWA and for any additional or substitute sites which may be approved for development and enhancement pursuant to this contract C Review and approve requests, with justification, to modify the design or cost estimates of each project described in Exhibit A or, in the discretion of the Project Leader, substitute a different project of a similar type and nature if a proposed project is deemed unfeasible as revealed by engineering surveys, water rights research, soil surveys, cultural surveys, projected construction cost overruns, or any other circumstance that would prohibit successful or cost - e LL chive com p letion of a project Compensation and Method of Payment The total cost of the State's contribution for these projects, described in Exhibit A shall not exceed $25,000 00 for the time period covered by this contract A Payments will be made upon receipt of invoices describing work completed on each project Upon approval of completed projects, payment shall be remitted to Northern Colorado Water Conservancy District whose address is P O Box 679, Loveland, Colorado 80539 4 Contract Representatives Jay A Stafford, whose address is 15630 Hams St Sterling, CO 80751, phone (970) 522 -4759, will serve as authorized contract representative for the Rtate and -hall he the cn- Prrnect Leader for the work to he nerfnrmed under this cnntrant -� -- --- - -- - -- - - -- - - -r -- - -- - -- - -- ---- -- -- r- --- ---- -- - --- ---- -- - - -- -- Jon Altenhofen, whose address is P O Box 679, Loveland, CO 80539, phone (970) 667 -2437, will serve as authorized contract representative for NCWCD and shall be the Project Leader for the work to be performed under this contract It is Mutually Agreed A All structures and facilities constructed on public land shall become the property of the State B Nothing herein shall be construed as obligating the State to expend any additional resources or incur any further expenditures of funds greater than the $25,000 00 obligated for work under this contract C The term of this agreement shall be from the date of final execution by the State Controller or his designee until December 31, 1998 D This agreement may be extended up to one (1) year if circumstances beyond the State's or NCWCD control prevent the completion of said projects within the Page 3 of 6
