File #612 98 <br />Tamarack Native Fishes Stream 98 <br />Amount $25 000 00 <br />Contact Person Jay Stafford <br />CONTRACT <br />PBA <br />Routing # 063aq <br />Log #184 <br />THIS CONTRACT, made this I jt day of ju - 1e- , 1998, between the State of <br />Colorado acting by and through the Department of Natural Resources for the use and benefit of <br />the Division of Wildlife, hereinafter referred to as the "State," whose address is 6060 Broadway, <br />Denver, CO 80216, and Northern Colorado Water Conservancy District, hereinafter referred to as <br />" NCWCD" whose address is P O Box 679, Loveland, Colorado 80539 <br />WHEREAS, required approval, clearance and coordination have been accomplished from <br />and with appropriate agencies, and the authority exists in the State law and funds have been <br />budgeted, appropriated and otherwise made available and a sufficient unencumbered balance <br />thereof remains available for payment in Fund Number 426, Agency PBA Org Unit 4150 , App <br />Code G98 Program 0640 GBL 7703. Obi Code 1910 Contract Encumbrance <br />Number thy) �a , in the amount of $25,000 00, and <br />WHEREAS, on November 3, 1992, the people of the State of Colorado enacted Article <br />XXVII to the Constitution of Colorado establishing a "Great Outdoors Colorado Program" under <br />wluch a "State Board of the Great Outdoors Colorado Trust Fund" ( "the Board ") was created to <br />be responsible for proceeds deposited from the Colorado Lottery in the "Great Outdoors <br />Colorado Trust Fund" ( "Trust Fund ") and to direct the Treasurer of the State of Colorado to <br />disburse expendable income from the Trust Fund as the Board may determine by resolution, and <br />WHEREAS, pursuant to §5 of Article XXVII, the Trust Fund shall be used, among other <br />things, for investments in the wildlife resources of Colorado through the Colorado Division of <br />Wildlife for such things as (I) the protection and restoration of crucial wildlife habitats, (ii) <br />appropriate programs for maintaining Colorado's diverse wildlife heritage, (iii) wildlife watching, <br />and (iv) education programs about wildlife and wildlife environment, and <br />WHEREAS, pursuant to a duly adopted resolution, the Board has directed that moneys <br />are disbursed from the Trust Fund for investment through the Colorado Division of Wildlife, as <br />provided herein <br />WHEREAS, the GOCO Board has granted funding for this cooperative project to <br />accomplish the projects described in Exhibit A, and <br />WHEREAS, the State and NCWCD have agreed to cooperatively develop an artificial <br />stream for the study of Habitat needs for native fish species in Colorado, and <br />WHEREAS, these cooperative projects, as set forth in Exhibit A, attached and <br />incorporated herein by this reference, will develop and enhance habitats for native fish species of <br />concern in Colorado <br />Page 1 of 6 <br />
