Beotion 1--Liabillty,of the Company��-�Phe company �hall

liable to such etockholder in damages, if such failure be c�.used
by an error in �udgment on the pert of those charged with tha
dietribution of water, by reason of the tact that euffioient water
be not available to the extent that each stoakholder could recelve
the share of �sater to �+hich he ie entitled, or by reaeon oi any
f act, thing, or circumetanae beyond the control of such pereon;
but the company ahall�only be liable in dame.ges to such etoak-
holder in caeo such f ailure to distribute water equally wae the
result of some r+ilful discrimination e.gainst euch stockholder on
