Board <br /> Hunter Creek <br /> historical consumptive use of 4.5 acre feet per year which <br /> equates to a consumptive use flow rate of 0.018 c.f.s. <br /> 6. Historically, the Koch Ditch No. 3 Extension water rights <br /> were used from May 15 to September 15. <br /> H. The Bulloch Spring and Pipeline <br /> 1. The Bulloch Spring and Pipeline holds priority No. 750 in <br /> former Water District 38. This right was decreed November <br /> 5, 1971, for .040 c.f.s. with an appropriation date of <br /> October 30, 1957. <br /> 2. The point of diversion for the Bulloch Spring and Pipeline <br /> is at or in Bulloch Springs at a point whence the E/4 cor- <br /> ner of sec. 5, TIOS R84W 6th P.M., bears S79 deg., 58'11 "E, <br /> 878.09 feet. <br /> 3. Source: Bulloch Spring. <br /> 4. The Bulloch Springs and Pipeline was decreed for domestic <br /> and other beneficial purposes. <br /> 5. Diversions to Bulloch Spring and Pipeline resulted in a <br /> historical consumptive use of 4.3 acre feet per year which <br /> equates to a consumptive use flow of 0.005 c.f.s. <br /> 6. Historically, the Bulloch Springs and Pipeline water rights <br /> were used from January 1 through December 31. <br /> 7. CWCB seeks to change the use of the above listed <br /> water rights by adding an alternative use, i.e. instream flow <br /> purposes to ensure the preservation of a minimum stream flow to <br /> preserve the natural environment to a reasonable degree. The <br /> exercise of the minimum instream flow use of the water right <br /> shall be within the exclusive control of CWCB and no other party <br /> or successor in interest to these rights shall be entitled to a <br /> minimum stream flow use of the water rights. In addition, while <br /> CWCB is using the water rights subject of this decree, they shall <br /> only be entitled to use the water at issue for instream flow pur- <br /> poses. <br /> 8. The Board is entitled to use any quantity up to the <br /> full decreed rate of flow for the above stated water rights for <br /> instream flow uses within the relevant stream channels beginning <br /> at the historic point of diversion of the subject water right as <br /> the upstream terminus to the historic return flow point located <br /> -6- <br /> t <br />
