1. PARTIES
This Contract (hereinafter called "Contract '') is entered into by and between AMEC Earth & Environmental Inc.
(hereinafter called "Contractor "), located at 355 South Teller Street, Suite 300, Lakewood, CO 80226, and the
STATE OF COLORADO acting by and through the Department of Natural Resources, Colorado Water
Conservation Board, 1313 Sherman Street, Suite 721, Denver, CO 80203 (hereinafter called the "State" or
"CWCB "). Contractor and the State hereby agree to the following terms and conditions.
2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY
This Contract shall not be effective or enforceable until it is approved and signed by the Colorado State
Controller or designee (hereinafter called the "Effective Date "). The State shall not be liable to pay or reimburse
Contractor for any performance hereunder including, but not limited to, costs or expenses incurred, or be bound
by any provision hereof prior to the Effective Date.
3. RECITALS
A. Authority, Appropriation, And Approval
Authority to enter into this Contract exists in CRS 37 -60 -101 and funds have been budgeted, appropriated
and otherwise made available pursuant to SB 08 -1346 and a sufficient unencumbered balance thereof
remains available for payment. Required approvals, clearance and coordination have been accomplished
from and with appropriate agencies.
