CDOW. SPWRAP and the other members of the Operating Committee <br />will assist CDOW in securing any needed permits and approvals to be <br />located on SWAs. <br />B. The Operating Committee will assist the CROW by providing: A) technical <br />assistance through the preparation of engineering analysis and reports in <br />support of all well permit applications, substitute supply plans, and water <br />right applications (such analysis may include, but is not limited to, <br />streamflow depletion /accretion analysis and water accounting <br />procedures); and B) expert testimony as necessary to assist CDOW in its <br />efforts to obtain a decree or decrees from the Water Division No. 1 Water <br />Court, thereby adjudicating the right to operate the recharge facilities for <br />the purposes contemplated under this agreement. <br />V. DEVELOPMENT and CONSTRUCTION <br />A. CROW approval is required for all construction documents, specifications, <br />schedules, and plans to ensure that the construction and operation of <br />these facilities will not interfere with the primary use and management of <br />the properties for the wildlife purposes by the CDOW. <br />B. The construction and installation of all wells, pumps, pipelines and ponds <br />necessary to develop the managed groundwater recharge projects on the <br />SWAs will be subject to the following limitations and conditions: <br />Installation and operation of a CDOW approved monitoring well <br />network to collect data for analysis of accretive or depletive effects of <br />the operation of the Project facilities on the South Platte River and the <br />effects of operation of the facilities (i.e., well pumping and recharge) on <br />warm water sloughs and the associated riparian vegetation. <br />2. At the option and sole expense of the CDOW, the ponds may be <br />partially lined to achieve wildlife management goals of the CDOW. <br />Prior to undertaking any such partial lining, CROW will consult with the <br />Operating Committee with regard to the amount and location of the <br />partial pond lining to be undertaken and the possible impact of such <br />lining on the generation of recharge credits and any additional pumping <br />costs that may result, if any. <br />C. The cost of construction of additional facilities, and major repairs or <br />reconstruction and replacement of Project facilities will be allocated <br />pursuant to procedures set forth in the CDNR- SPWRAP MoA. <br />Tamarack MOU <br />
