II. PLANNING <br />A. The parties envision that development of the Project will proceed in <br />accordance with the proposed action described in Section III of the EA for <br />a recharge project located on the TRSWA and PESWA. The Operating <br />Committee has created a "Development Plan" showing various <br />development phases along with the proposed locations of all Project <br />features including wells with pumps, pipelines, and recharge ponds <br />(attachment C). The Development Plan shall require approval by CDOW <br />to ensure compliance with the EA, and with Pittman - Robertson Act ( "P -R ") <br />and with USDOI rules and regulations as provided in C.R.S. Section 33 -1- <br />117. The Project is envisioned to pump an average of 30,000 acre -feet of <br />water annually into recharge ponds that will re- regulate these flows back <br />to the South Platte River to meet goals and objectives of the State of <br />Colorado. <br />B. If implementation of the Water Projects Plan requires construction of <br />facilities in SWAs other than the TRSWA or PESWA, or if construction of <br />water recharge facilities on said SWAs will materially deviate from the <br />Development Plan, the parties hereto shall ensure that such construction <br />complies with the Pittman - Robertson Act (P -R) and with USDOI rules and <br />regulations as provided in C.R.S. § 33 -1 -117. <br />C. If material changes from the Development Plan for the Project are <br />expected or development is anticipated to take place on other SWAB, the <br />Operating Committee will provide a revised Development Plan for <br />approval by CDOW. Upon approval, CDOW will initiate action to secure <br />necessary permits and approvals. <br />III. DEVELOPMENT REPORT <br />A. By March 31, 2009 the Operating Committee described in Paragraph 1, will <br />prepare and submit to the CDNR Executive Director a "Development <br />Report" that will contain an estimate of the cost of further development of <br />the Project in accordance with the Development Plan, along with an <br />estimate of operations and maintenance costs, for current and future <br />Project features including labor costs at various levels of development. <br />1V. FACILITY PERMITTING <br />A. CDOW is responsible for securing any needed permits and approvals <br />pertaining to facilities to be located on SWAs. These include, but are not <br />limited to: applications for federal assistance, well permit applications, <br />substitute supply plans, and water rights applications. All such <br />applications, permits, and approvals will be filed in the name of the <br />4 Tamarack MOU <br />
