• 2. BACKGROUND AND CDOW'S APPLICATIONS FOR WATER RIGHTS <br /> 2.1 Background <br /> The Project is located at the Tamarack Ranch SWA in Logan County. The SWA is composed of two <br /> general areas: 1) the riparian area along the South Platte River starting at the Proctor Road (County Road <br /> 670) and extending east over 6 miles to the Crook Road (State Highway 55); and 2) the main area that <br /> includes both the riparian area south of the South Platte River and portions the Sand Hills and extends <br /> along the South Platte River from the Crook Road (CO55) east over 8 miles to the Red Lion Road <br /> (County Road 93). The Project is located in the main area of the Tamarack Ranch SWA. Figure 1 <br /> shows the boundaries of the main Tamarack Ranch SWA area which is the focus of this application. <br /> Other water rights on the Tamarack Ranch SWA outside of the Project are: <br /> a. Irrigation Wells: Two CDOW irrigation wells are located on the Tamarack Ranch SWA and are <br /> decreed in W -6472 as Well Nos. 17 (Permit No. 6277F) and 18 (Permit No. 6278F). Well 17 was <br /> last pumped in 1997 and Well 18 was last pumped to irrigation in 1998. Well 18 was improperly <br /> used as a courtesy tin 2002 to fill Colorado Department of Transportation water trucks for a <br /> nearby construction project on Interstate 76. The total amount diverted was less than 2 acre -feet. <br /> Stream depletions from these wells were covered by Groundwater Appropriators of the South <br /> Platt until the end of the 2003 water year (Halstead, January 10, 2007). <br /> b. Hill Well Decree: Conditional water rights decreed in W -7713 (04CW252). This decree is for <br /> seven wells with up to 25wildlife ponds not to exceed a total surface acreage of 255 acres. The <br /> well depletions will be augmented using the changed Tamarack Ditch water right and releases <br /> from onsite storage. <br /> 2.2 CDOW's Applications <br /> In its applications in Consolidated Case Nos. 96CW1063 and 98CW463 and amendments thereto, <br /> CDOW claimed the following priority dates: <br /> Case No. 96CW1063: Recharge Well #1 claims a 1996 conditional water right with an <br /> December 31, 1996 appropriation date. The application for Recharge Well #1 was filed in <br /> the water court in the year of 1996 and the right thus should be administered as having <br /> been filed in that year, and shall be junior to all priorities filed in previous years. <br /> Case No 98CW463: Recharge Wells #2 through #17 claim a 1998 conditional water <br /> rights with a December 31, 1998 appropriation date. The application for Recharge Wells <br /> #2 through #17 was filed in the water court in the year of 1998 and the right thus should <br /> be administered as having been filed in that year, and shall be junior to all priorities filed <br /> in previous years. <br /> The applications ': were amended in December 2002 to add the plan of augmentation for the <br /> recharge wells. A second amended application was filed in September 2006 to change the <br /> locations and pumping rates for Recharge Wells #14 through #17. <br /> 3 Page <br />
