8.0 OPERATION OF PROJECT <br /> This section describes the recommended operation of the Project. <br /> 8.1 Terms and Conditions for Diversion of Recharge Water <br /> CDOW seeks the right to divert its recharge rights during the entire year. However the following <br /> restrictions are proposed: <br /> Projection tool prior to well operations. Prior to operating the wells, the Division of <br /> Wildlife will model predicted depletions and accretions (based on the depletions and <br /> accretion factors set forth in this decree) for its planned operations. In the event that <br /> predicted depletions exceed predicted accretions, the Division of Wildlife shall change its <br /> operational plans to pump the recharge wells into recharge areas or ponds at closer <br /> locations to the river or shall make releases from Recharge Facilities capable of direct <br /> discharge to the South Platte River until the accretions or releases exceed river <br /> depletions. The projections will be based on the following limitations and assumptions: <br /> The projection shall be completed assuming there is a South Platte River call senior to the <br /> priorities of the recharge water rights from April 1 to October 15 each year. <br /> Non - Compact season call operational adjustment. If a river call by a senior water <br /> right downstream-of-the-Tamarack-Ranch S_W_ _A_occurs anytime between October 15 and <br /> April 1, CDOW will immediately cease well diversions and make releases from Recharge <br /> • Facilities capable of direct discharge to the South Platte River to offset any net depletions <br /> to the South Platte River, unless there are sufficient recharge accretions available from <br /> past operations to off -set any out of priority depletions caused by well operations. <br /> Senior Downstream Call. The wells shall not operate at any time senior downstream <br /> water rights are calling unless sufficient recharge accretions from the recharge plan <br /> decreed herein exist to offset lagged depletions from well operations. <br /> Call. CDOW may not place a call on any upstream water right that makes its diversions <br /> from the South Platte River, or any tributaries thereof, or the alluvium of the South Platte <br /> River or its tributaries, for the purpose of satisfying the decreed water right for any well <br /> that is the subject of this decree or any future amendment to this decree. CDOW shall not <br /> request the State or Division Engineers or the water commissioner for District 64 to <br /> shepherd accretions under this decree past downstream calling water rights in Colorado, <br /> including, but not limited to, when the accretions are accruing to the South Platte River <br /> pursuant to Colorado's Platte River Recovery Implementation Program obligations. <br /> Volumetric Limit. The annual volumetric diversion limit on the 17 wells decreed herein <br /> shall be 20,000 acre feet. This limit applies to both in- priority and out -of- priority <br /> diversions. <br /> Live Stream. CDOW shall not operate the wells decreed herein if operation of the wells <br /> causes the dry -up of the South Platte River at any point on the Tamarack Ranch SWA. <br /> • <br /> 18 'Page <br />
