4. Appropriate losses associated with the conveyance of water down the river to lower <br />administrative reaches will be assigned a conveyance loss of 0.5 percent per mile <br />betwe,en reaches. The conveyance of these excess supplies will be administered past <br />ditch river headgates where required by the Division 1 Engineer. <br />5. WAS will measure all replacement water through appropriate augme�tation structures <br />and/or coordinate with the Water Commissioners to bypass water past river headgates. <br />6. WAS anticipates having sufficient recharge credits, augmentation well water, bypass <br />flows and surface water leases available to make required replacement of out of priority <br />depletions resulting &om pumping of inember wells during the 2004 irrigation season. In <br />ti�e event, however, that a priority call occurs at any time during Apri12004 through <br />Mazch 2005 and WAS does not have sufficient replacement sources to cover its member <br />well out of priority depletaons, augmentation well depletions and return flow obligations, <br />WAS agrees to: <br />a. Use its available replacement sources to cover, to the �tent possible, Apri12004 <br />through March 2005 member well out of priority depletions, augmentation well <br />out of priority depletions and historic return flow obligations ariribut� to its <br />replacement sowces as shown in Table 6. <br />b. Pursue cash settlements to mitigate any April 2004 — March 2005 injury to senior <br />reservoir water rights only if the owner of the senior reservoir right agrees to a <br />cash settlement in-lieu of replacement water. <br />c. Allow the State Engincer to curtail well pumping in 2004 from WAS member <br />wells to the extent necessary to not �ceed available replacement sources listed in <br />Table 5. <br />9.0 INHERITED POST-PUMPING 2003 WINTER DEPLETIONS <br />Many WAS wells were formerly included in either: (1) the South Platte Well Users Association <br />(SPWUA), who received approval of a SWSP covering all depletions through Mazch 31, 2004, <br />or (2) Ground Water Appropriators of the South Platte (GASP), who received approval of an <br />SWSP covering depletions resulting from pumping for the years 1974-2002 through August 22, <br />2004. Each of these entities is contractually obligated to provide �e require� replacement water <br />on behalf of its members and WAS asswnes that these obligations will be met. If, however, <br />either SPWUA or GASP fails to meet its obligations under its approved SWSP, as demonstrated <br />by a communicati� from the Office of �e State Engineer so stating, WAS will �deavor to <br />meet these obligations to �e exter�t ne�essary to prevent injury to vested, calling water rights in <br />the South Platte River Basin. <br />P:\Data\GEN\CCWCD\25087\SWSP WAS\2004 WAS SWSP (FINAL).doc 13 <br />
