t ' , <br />The applicant states that it is willing and able to enter into <br />_ a suitable contract with the United States for the repayment of <br />the full amount of the loan in not to exceed 50 years. <br />12. The applicant understands that those lands receiving water which <br />are in excess of 160 acres in a single ownership must pay interest <br />on their proportionate share of the total amount of the loan. <br />13. -The applicant understands that approval of the loan is subject to <br />the approval of the report which will accompany the application; <br />such approval being:. dependent upon: <br />(a) Estimated construction cost being adequate as a basis for <br />determining the amount of the loan. <br />(b) Plans being according to sound engineering principles. <br />. t (c) The water users having the ability to repay the amount of <br />the loan within the repayment period and to,pay an annual <br />operation, maintenance and replacement charge sufficient to <br />adequately operate and maintain the works-. <br />(d) Costs allocated to nonreimbur <br />Federal expenditures. sable purposes being justified <br />d <br />14. The applicant understands that the report accompanying the appli- <br />cation must be submitted to the affected states for review in a <br />_like manner to that provided in Section 1(c) of the Flood Control <br />Act'of 1944; that planning and construction of the project must <br />be reviewed by the Federal and State Fish and Wildlife organizes- <br />.. tions in accordance with the provisions of the Act of August 14 ' <br />1946; that those parts of plans involving nonreimbursable purposes <br />must be cleared with - the Federal agencies primarily concerned; <br />that the Governor of the State in which the project '_ocated <br />must find that the project is financially feasible. <br />15. The applicant understands that all work performed by the Bureau <br />of Reclamation, in preparation of the application at the request <br />of the District, must be paid for in advance by the District; <br />that all costs incurred by ,the Bureau of Reclamation in processing <br />the application and administering the loan, in excess of the <br />} 1,000 filing fee, become a part of the loan; that funds, if <br />required, for preconstruction activities, including the prepara- <br />tion of designs and specifications, will be advanced upon approval <br />of the loan by the Secretary and upon consummation of the repay - <br />ment contract; that funds for construction will be advanced by <br />t program units upon approval by the Bureau of Reclamation of the <br />designs and specifications for those program units, such approval <br /> E 4 <br /> z. <br />Yr ?Of XE?O <br />XF .O; <br />
