0 V <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights, filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affbcted by the date of entry of ruling. The Applicant shall install and maintain such <br />measuring devices and keep such records as the Division Engineer may require for <br />administration of this right. <br />L Terms and Conditions.: The historic irrigation patterns and practices <br />claimed by Mika Ag Corporation (d/b/a Escalante Land and Cattle Corp) in Case <br />No. 05CW266, including the accumulation and rotation of available irrigation <br />water among the numerous points of diversion, constitute historic undecreed uses <br />and practices under section 37-92-102(3)(b), C.R.S. that were occurring on or <br />before the date the CWCB appropriated its instream flow water right on Escalante <br />Creek in Case No. 05CW250. Pursuant to section 37-92-102(3(b) C.R.S., the <br />CWCB's instrearn flow rights on Escalante Creek in Case No. 05CW250 shall be <br />subject to such historic uses and practices which are set forth in the claims for the <br />following described surface water rights, change of water right for use of stored <br />water, and changes of water rights for alternate points of division as requested by <br />Mika Ag Corporation (d/b/a Escalante Land and Cattle Corp) in Case No. <br />05CW266: <br />A. Surface Structures: <br />1. ER Sawtell Spring No. 1: 0,5 c.f s., irrigation and stock water, ABSOLUTE <br />and 0.0333 c.f.s. domestic, ABSOLUTE. <br />2. ER Sawtell Spring No. 2: 0.5 c.f.s., irrigation and stock water ABSOLUTE. <br />3. ER Bloomberg Spring No. 1: 0.5 c1s., irrigation and stock water <br />ABSOLUTE. <br />4. ER Bloomberg Spring No. 2: 1.0 c.f.s., irrigation and stock water, <br />ABSOLUTE. <br />5. ER Bloomberg Spring No. 3: 0.25 c.f.s., irrigation and stock water, <br />ABSOLUTE. <br />6. ER Bloomberg Spring No. 4: 0.75 c1s, irrigation and stock water, <br />ABSOLUTE. <br />7. ER Bloomberg Spring No. 5: 1.0 c.f s, irrigation and stock water, <br />ABSOLUTE. <br />8. ER.
