0 9 <br />2. The name of stream involved: Escalante Creek <br />3. The source of the water is: Escalante Creek <br />4. Legal description of the stream segment through which an instream flow is claimed <br />a. The natural stream channel from the confluence of the East Fork and <br />Middle Fork Escalante Creek at latitude 38 34' 55" N and longitude <br />148 24' 21" W as the upstream terminus and extending to the <br />headgate of Knob Hill Ditch at latitude 38° 37' 34" N and longitude <br />108 23' 48" W as the downstream terminus, being a distance of <br />approximately 3.9 miles. This segment can be located on the <br />Escalante Forks and Kelso Point U.S.G.S. quadrangles. <br />b; For administrative purposes only: <br />Upper Terminus = NW SW S23 T50N R14W NMPM <br />922' East of West Section Line 2106' North of South Section Line <br />UTM 42 75 896N 13 2 03 305E <br />Lower Terminus = NW SE S2 T50N R14W NMPM <br />1685' West of East Section Line 2330' North of South Section Line <br />UTM 42 80 749N 13 2 04 288E <br />Use of the water: <br />Instreani flow to preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />§ § 37- 92- 102(3) and 37 -92- 103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 3.20 cfs (Mar. <br />__ Mar. 31), 11.50 cfs (Apr. 1 - June 14), 3.20 cfs (June 15 - July 31), and 1.30 cfs (Aug. <br />— Feb. 28). <br />THE WA'T'ER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of 3.20 cfs (Mar. 1 <br />— Mar. 31), 11.50 cfs (Apr. 1 - June 14), 3.20 cfs (June 15 - July 31), and 1.30 cfs (Aug. 1 <br />-- Feb. 28) is hereby entered to preserve the natural environment to a reasonable degree in <br />the reach of Escalante Creek between the upstream and downstream points described in <br />paragraph 4 above. The appropriation date for this water right is January 25, 2005. <br />
