Arkansas River in the North -west Quarter of the South-west Quarter
<br />of Section Thirty -six (36), Township Twenty -two (22) South, of Range
<br />Forty -eight (48) :'Test, and also The Buffalo Creek Canal, having its
<br />headgate on the Arkansas River in Section Thirty -five (35), T ownship
<br />Twenty-two (22) South, of Range Forty -four (44) 'Nest of the Sixth
<br />Principal Meridian, both in Prowers County, Colorado and which said
<br />company was and is, the owner of the follo -tming named reservoirs, to-wit:
<br />Neesopah Reservoir, Neegronda Reservoir, Neosho or Nenoshes Reservoir,
<br />and The Queen Reservoir, sometimes called Nenoshee Reservoir, and The
<br />Queen Reservoir, sometimes called Neeskah, all of which said reservoirs
<br />being situated in Provers County, Colorado, and being supplied by water
<br />from the Arkansas River, and by means of The Fort Lyon Canal, and through
<br />what is known as the Kicking Bird Canal, which canal in turn is connected
<br />with the Fort Lyon Canal.
<br />AND 'fIiER&%S, the said The Las Animas Ditch Company was at the
<br />time of the commencement of said pending suit, and now Is, the owner of
<br />a certain irrigating canal or ditch known as the Town Ditch, or the Town
<br />Ditch of West Las Animas, having its headgate on the south bank of the
<br />Arkansas River, in Section One (1)a Township Twenty -three (23) South,
<br />of Range Fifty-three (53) West of the Sixth Principal Meridian, in Bent
<br />County, Colorado.
<br />AND 'AMRF,AS, the said The Las Animas Consolidated Canal Company
<br />was at the time of the commenoement of said pending suit, and now is, the
<br />owner of a certain irrigating canal or ditch known as the Jones Ditch,
<br />having its headgate on the south bank of the Arkansas River, in Section
<br />Nine �9), Township Twenty -three ( 23) South, of Range Fifty -three (53)
<br />West of the Sixth Principal Meridian, in Bent County, Colorado, and of
<br />a certain other irrigating canal or ditch known as the Riverside Ditch,
<br />having its headgate on the south bank of the Arkansas River in Section
<br />Ten (10), Township Twenty -three (23) South, of Range Fifty-three (53)
<br />West of the Sixth Principal Meridian, in Bent County, Colorado.
<br />AND ` :4 HEREAS, the said The Excelsior Irrigation Company was at
<br />the time of the commencement of said pending suit, and now is; the owner
<br />of a certain irrigating canal or ditch known as the Excelsior Ditch,
<br />having its headgate on the north bank of the Arkansas River, in Section
<br />Thirty - 'two (32), Township Twenty (20) South, of Range Sixty -three (63)
<br />West of the Sixth Principal Meridian, in Pueblo County, Colorado.
<br />AND ?VHE w S, all or various of the second parties separately
<br />were at the time of the commencement of said pending suit; and are now,
<br />the owners of ditches, reservoirs and water rights* or clair7s'of priority
<br />therefor, other than those hereinbefore specifically mentioned, and sup-
<br />plied or to be supplied with water in Colorado from the Arkansas River
<br />and its tributaries, under claims of priority antedating August 27, 1910.
<br />AND adHEREAS the pendency of said pending suit has had a dis-
<br />turbing and detrimental effect upon and has rendered uncertain the
<br />values of real estate and lands under each and every one of the ditches
<br />hereinbefore mentione4, and has had a like disturbing and detrimental
