AND !"IMEREAS, the said The Twin Lakes Reservoir Company was at <br />the time of the commencement of said pending suit the owner of a certain <br />reservoir called the Twin Lakes Reservoir, which said reservoir was and <br />is situated in Lake County, Colorado, on what is known as Lake Creek, <br />which said Creek in turn empties into and constitutes a natural tribu- <br />tary of the said Arkansas River, but which said The Twin Lakes Reservoir <br />Company has since the commencement of this suit changed its corporate <br />name to The Twin Lakes Reservoir and Canal Company, and said reservoir <br />is still owned by said company. <br />AND liffEREAS, in the said bill of complaint in said pending suit, <br />that certain reservoir known as Lake Henry, taking water from the Arkan- <br />sas River through said Colorado Canal, at the time of the commencement <br />of said suit situated in Otero County, Colorado, but now situated in <br />Crowley County, Colorado, was and is incorrectly referred to as the proper- <br />ty of the defendant The Twin Lakes Land and '.'Eater Company, but which reser- <br />voir was then and now is, as a matter of fact, owned by the said The <br />National Sugar Manufacturime Company. <br />AND ':'MREAS, the said The Bessemer Irrigation Ditch Company, was <br />at the time of the commencement of said pending suit and now is the owner <br />of a certain irrigating canal or ditch known as the Bessemer Ditch, the <br />headgate of which is situated on the south bank of the Arkansas River in <br />Section Thirty -three (33), Township Twenty (20) South of Range Sixty -six <br />(66) west of the Sixth Principal Meridian, in Pueblo County, Colorado, <br />AND 1HEREAS, the said The Holbrook Irrigation District was at <br />the time of the commencement of said pending suit and now is the owner of <br />that certain irrigating canal or ditch known as the Lake Canal, the head- <br />gate of which is situated on the north side of the Arkansas River in Otero <br />County (now Crowley County) in the State of Colorado in Section Twenty - <br />four (24) Township Twenty -two (22) South, of Range Fifty -eight (58) West <br />of the Sixth Principal Meridian, and was and is also the owner of those <br />certain reservoirs known as Holbrook Lake or Reservoir No. 1, and the Dye <br />Reservoir, said reservoirs being supplied with water by means of the said <br />Lake Canal and being situated in Otero County, Colorado, <br />AND 1^7HEREAS, the said The Otero Irrigation District was at the <br />time of the commencement of said pending suit and is now the owner of a <br />certain irrigating canal or ditch known as the Otero Canal., the same hav- <br />ing its headgate on the south side of the Arkansas River in Section Seven- <br />teen (17), Township Twenty -two (22) South of Range Fifty -nine (59) hest in <br />Otero County, Colorado, and was and is likewise the owner of a certain <br />_ reservoir known as Clear Creek Reservoir, the same being situated in Town- <br />ship Twelve (12), South of Range Seventy -nine (79) west of the Sixth Prin- <br />cipal Meridian, in Chaffee County, Colorado, on a stream known as Clear <br />Creek, the same being a tributary of the Arkansas River. <br />AND .WHEREAS, the said The Arkansas Valley Sugar Beet and <br />Irrigated Land Company was at the time of the commencement of said pend- <br />ing suit and now is the owner of a certain irrigating canal or ditch <br />known as the Amity Canal, having its headgate on the north side of the <br />" 7 of <br />
