Legal description o f the stream segment through which an i nstrearn flow is <br />claimed: <br />tt� The natural stream channel from the confluence with the North and <br />South Smith Forks at latitude 38' 43' 31 N and longitude 107' 28' <br />23" W as the upstream terminus and extending to the confluence with <br />Little Coal Creek at latitude 38° 43' 43 N and longitude 107' 31' 39" <br />W as the downstvam terminus, being a distance of approximately 3.9 <br />miles. This segment can be located on the Crawford & Mount Guero <br />U.S.G.S. quadmagles. <br />b. For administrative purposes only: <br />Upper Terminus - <br />UTM 4289187N 285021E <br />NE NW S29 T15S R90W 6PM <br />345 feet South of the North Section Line <br />2397 feet East of the West Section Line <br />Lower Terminus - <br />UT M 4289709N 280286E <br />SW SE S23 T15S R91W 6 PM, <br />2209 feet West of the East Section Line <br />667 feet North of the South Section Line <br />5. Use of the water <br />Instream flow to, preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: <br />J anuary 25, 2005. <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />§ § 37-92-102(3) and 37-92-103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): lnstrearn flow of 7.7 cfs (Mar. I <br />— Mar. 31); 12.9 cfs (Apr. 1 -- July 31); 7.7 cfs (Aug.
