ENDANGERED SPECIES ACT <br />• Section 4 provides that: <br />(f) The Secretary (of the Interior] shall <br />develop and implement plans (hereinafter in <br />this subsection referred to as "recovery <br />plans ") for the conservation and survival of <br />endangered species and threatened species <br />unless he finds that such a plan will <br />not promote the conservation of the <br />species. The Secretary, in developing and <br />implementing recovery plans (1) shall, to <br />the maximum extent practicable, give <br />priority to those endangered species or <br />threatened species most likely to benefit <br />from such plans, particularly those species <br />that are, or may be, in conflict with <br />construction or other developmental projects <br />or other forms of economic activity, and (2) <br />may procure the services of appropriate <br />public and private agencies and <br />institutions, and other qualified persons. <br />Recovery teams appointed pursuant to this <br />subsection shall not be subject to the <br />Federal Advisory Committee Act. <br />• The term "conservation" is defined in section 3 of the Act <br />as follows: <br />(3) The terms "conserve," "conserving," and <br />"conservation" mean to use and the use of <br />all methods and procedures which are <br />necessary to bring any endangered species or <br />threatened species to the point at which the <br />measures provided pursuant to this Act are <br />no longer necessary. ... <br />The consultation process is set forth in section 7. The <br />relevant provisions are as follows: <br />(a)(2) Each federal agency shall, in consultation <br />with and with the assistance of the Secretary, insure <br />any action authorized, funded, or carried out by such <br />agency (hereinafter in this section referred to as an <br />"agency action ") is not likely to jeopardize the <br />continued existence of any endangered species or <br />threatened species or result in the destruction or <br />adverse modification of the habitat of such species <br />which is determined by the Secretary, after <br />consultation as appropriate with affected states, to <br />. be critical, unless such agency has been granted an <br />exemption . pursuant to subsection (h) of this <br />section. ... <br />0424E <br />
