Mr. Merriman also possesses knowledge about the Board's <br />responsibilities to: 1) promote the conservation of the waters of the state of Colorado; 2) <br />secure the greatest utilization of such waters; 3) foster the conservation of the water of the <br />state of Colorado by the promotion and implementation of sound measures to enhance <br />water use efficiency in order to serve all the water needs of the state; and 4) assure the <br />availability of adequate supplies for future uses. Mr. Merriman has reviewed the <br />application in this matter, and with particularity, those portions which may violate the <br />statutory provisions which vest the CWCB with the exclusive authority to hold instream <br />flow water rights and those portions that may not constitute a legally cognizable <br />beneficial use of that water. <br />7. Mr. Kowalski <br />possesses knowledge about the CWCB's actions pursuant to section 37 -92- 102(3) and the <br />CWCB's Instream Flow and Natural Lake Level Program. Mr. Kowalski possesses <br />knowledge about water rights administration, the beneficial use requirement of water <br />appropriations, and about waste issues. Mr. Kowalski also possesses knowledge about <br />the Board's responsibilities to: 1) promote the conservation of the waters of the state of <br />Colorado; 2) secure the greatest utilization of such waters; 3) foster the conservation of <br />the water of the state of Colorado by the promotion and implementation of sound <br />measures to enhance water use efficiency in order to serve all the water needs of the state; <br />and 4) assure the availability of adequate supplies for future uses.
