Town of Vail - Town Council - Agendas - Work Session Agenda - Archive - June 13, 2000 Page 3 of 5 <br />BACKGROUND RATIONALE: The appellant, Kathleen Ferry, went befo <br />the Town of Vail Planning and Environmental Commission (PEC) on Ma <br />8th to request a variance from Section 12 -6C -9, Town of Vail Code in <br />conjunction with a proposed residential addition at the above - referenced <br />property. This request was for development of the lot with a site coverag <br />of 22.2% of lot area (applicable zoning allows a maximum site coverage <br />20 %). The Planning and Environmental Commission held that there are <br />physical hardships or unique characteristics on the property that warrant <br />deviation from the zoning regulations and that approval of this variance <br />request would constitute a grant of special privilege. The PEC voted <br />unanimously (Galen Aasland abstaining) to deny the request. <br />A staff memo, the applicant's statement of the request and relat <br />correspondence have been forwarded to the Town Council. <br />STAFF RECOMMENDATION: Staff recommends that the Town Coun <br />uphold the Planning and Environmental Commission's denial of t <br />variance request, subject to the following findings: <br />1. That the granting of the site coverage variance will constitute a gr <br />of special privilege inconsistent with the limitations on of <br />properties classified in the Primary/Secondary Residential Zo <br />District. <br />2. There are no exceptions or extraordinary circumstances <br />conditions applicable to this site that do not apply generally to of <br />properties in the Primary/Secondary Residential Zone District. <br />3. That the strict interpretation or enforcement of the specifi <br />regulation does not deprive the applicant of privileges enjoyed by t <br />owners of other properties in the Primary/Secondary Resident <br />Zone District. <br />T4 <br />rw <br />4.
