Town of Vail - Town Council - Agendas - Work Session Agenda - Archive - June 13, 2000 Page 2 of 5 <br />BACKGROUND RATIONALE: On May 8 the Town of Vail Planning a <br />Environmental Commission (PEC) voted (6 -1, Doyon against) to approv <br />the Town's request to provide boating and fishery amenities within Gore <br />Creek. The PEC's approval carried two conditions: <br />1. The timing of construction will be coordinated with the <br />Colorado Division of Wildlife to ensure trout spawning activiti <br />are not adversely impacted; and <br />2. Proper signage, benches, picnic tables, trash, and kayak <br />carriers on bus transportation will be addressed as part of th <br />long -term management plan. <br />The Village Center Condominium Association, represented by their <br />attorney, filed an appeal of the PEC's approval of this proposal. In <br />accordance with the provisions of Section 12 -3 -3, Vail Town Code, <br />hearing has been scheduled before the Vail Town Council to discu <br />this matter. <br />STAFF RECOMMENDATION: The Community Development Departme <br />recommends that the Vail Town Council uphold the Planning and <br />Environmental Commission's approval of the proposed modifications to <br />the Gore Creek Flood Plain, located at the Gore Creek Whitewater Park, <br />Gore Creek Promenade / Tracts I & A, Block 5B, Vail Village 1St Filing, <br />subject to the following findings: <br />That the proposed location of the flood plain modification and the <br />conditions under which it would be operated or maintained would n <br />be detrimental to the public health, safety, or welfare or materially <br />injurious to properties or improvements in the vicinity. A complete <br />floodplain analysis conducted by a qualified consultant indicates <br />adjacent properties will not be adversely impacted by this proposal <br />3.
