Non-Reimbursable Application - CWCB Construction Fund <br />Form Revised August 2004 <br />5. Explain why you are requesting a grant, instead of a loan. (the Construction Fund exists primarily to <br />provide low interest loans for the construction or rehabilitation of raw water projects. Non- <br />reimbursable investments are approved only when the project or study is of statewide interest and <br />benefits a wide range of people and organizations, and/or a large geographical area . <br />The RRWCD was created in 2004 to assist the State of Colorado in meeting Republican River <br />Compact obligations and to preserve the agricultural economy in seven northeastern Colorado <br />counties. A threshold decision by U.S. Supreme Court Special Master McKusick held that ground <br />water pumping from the Ogallala aquifers is indeed subject to the Repulican River Compact. <br />Colorado, therefore, must undertake swift and calculated measures to return to compliance. Pursuant <br />to the U.S. Supreme Court-affirmed Final Settlement Stipulation of 2002, Colorado must take <br />definitive actions necessary to meet our compact obligations as required in a five-year moving <br />average of required compact deliveries. The first five-year period concludes with 2007. <br />The critical first-year projects and studies undertaken by the RRWCD, therefore, are of great <br />significance to both the northeast plains and to the entire state. The district was established in part to <br />provide local decision-making authority to those most affected by the reduction of consumptive use. <br />Their decisions, which will be based on these studies, and the implementation of these projects will <br />rely partially on external funds. The district, empowered with taxing and fee-assessment authority, <br />will also generate its own funds. This grant is necessary to initiate the aforementioned first-year <br />studies and projects. <br />6.
