<br />beneficial purposes; to protect all water rights, filings on water rights, other
<br />water supplies, for the interests of AGUA, through any and all legal or other
<br />proceedings including, but not limited to opposing other water rights
<br />applications.
<br />Acquire, develop and operate a permanent water supply, including but not
<br />limited to, a supply provided or protected pursuant to a plan for
<br />augmentation and/or a substitute supply plan; to dig, bore, drill, or
<br />otherwise excavate wells and tunnels; to construct, acquire and operate
<br />pumping plants, water storage, diversion and distribution systems, recharge
<br />facilities; to acquire, construct, maintain and operate a system for the
<br />diversion, supply, storage and disti of water to its members, or for
<br />the benefit of its members, for beneficial purposes within the azea served by
<br />AGUA.
<br />Enter into all necessary contracts, to make any and all reports, to conduct or
<br />participate in all necessary experiments, to compile data, to employ
<br />personnel, including engineers, attorneys, and other consultants, and to do
<br />each and every thing necessary or advisable to advance the purposes of
<br />AGUA.
<br />Rent, lease, own, exchange, construct, remodel, repair, purchase, hold,
<br />mortgage, sell, transfer; trade, loan, and to otherwise have, use and dispose
<br />of each and every item of personal or real properry which may be necessary
<br />or desirable in the conduct of the affairs, or to achieve the purposas of
<br />AGUA.
<br />(g) Borrow money for the use of AGUA, to issue securities therefor, and to
<br />pledge, mortgage, hypothecate, and otherwise dispose of the real, personal,
<br />and intangible property of the AGUA as security therefor.
<br />(h) Establish schedules of chazges and assessments necessary to offset all costs
<br />of the Association and for the delivery of water, either directly to its
<br />members or to other vested water rights for the benefit of its members, or
<br />for the provision of water pursuant to a plan for augmenta.tion or substitute
<br />supply plan, and to collect such water charges and assessments from it's
<br />members. Such costs shall include all administrative and other costs
<br />associated with such water supplies including, but not limited to, costs of
<br />obtaining, maintaining, and defending or protecting such water supplies.
<br />Such costs shall also include, but are not limited to, fees of engineers,
<br />atto:neys, or other consultants, costs of lit;gation or other judicial or
<br />administrative proceedings, and system development and maintenance
<br />costs.
<br />The foregoing clauses shall be construed both as objects and powers and shall not
<br />be held to limit or restrict in any manner the general powers of AGUA, and the enjoyment
<br />and exercise thereof, as conferred by the laws of the State of Colorado.
<br />2. Powers: In furtherance of the foregoing purposes, AGUA shall have and may
<br />exercise a11 of the ri,�hts, powers and privileges now or hereafter conferred upon
<br />non-profit corporations organized under the laws of the State of Colorado. In
<br />addition, it may do everything necessary, suitable or proper for the accompIishment
<br />of any of its purposes.
