10 am or 5 pm in order to ensure maximum utilization of water until the Division <br />Engineer has a reasonable basis to believe that the RICD water right is being put to <br />beneficial use at those times. <br />Despite any periods of non -use, the Division Engineer also may honor a call if the <br />RICD Agent informs him/her of special recreational events. (i.e., Fourth of July, <br />kayaking competitions, etc.) <br />The RICD agent may only call the RICD right if there is a reasonable basis to believe <br />that the RICD water right will be put to beneficial use. If the RICD Agent has reason to <br />believe that a call placed on a given day was wasted because no one used the RICD water <br />right, that individual has an obligation to report this to the Division Engineer if desiring <br />to place another call the next day. While not required, the RICD water rights holder is <br />encouraged to determine and report use through by either placing a registration list for <br />users at the RICD site or on a sign -up website list. <br />The Division Engineer may in his or her discretion rely on the statements of <br />others to determine a whether the RICD water right was put to beneficial use if there is a <br />reasonable basis for support. <br />If the Division Engineer has his or her own reasonable basis to believe that a call <br />was placed on day 1 and no one recreated on the course, the Division Engineer may <br />determine not to honor a call for Day 2, but may honor a call for the following day, and <br />so on. Thus, for example, if a water right is called on June 1, for a lagged -time use on <br />June 2, and no one uses the course on June 2, the applicant has wasted water and <br />prevented optimal use of water by junior users upstream of the RICD, and the Division <br />Engineer should not honor a call for the following day or June 2 for a use on June 3. <br />However, the Division Engineer may honor a call for the following day (call on June 3 <br />for June 4) if there is a reasonable basis to believe that the RICD water right will be <br />beneficially used. Same concern about the day before issue <br />If the Division Engineer has a reasonable basis to believe that a call was placed <br />for a 12 -hour use and only one person recreated on the course for one hour, the Division <br />Engineer may not honor a 12 -hour call for the following day but may restrict that call to <br />less than 12 hours. The Division Engineer may honor a full 12 -hour call for the <br />following restricted call if there is a reasonable basis to believe that the full call will be <br />used. Thus, for example, if a water right is called on June 1, for a lagged -time use on June <br />2, and there is a one -hour use on June 2, the applicant has wasted water and prevented <br />optimal use of water by junior users upstream of the RICD, and the Division Engineer <br />should not honor a 12 -hour call for the following day or June 2 for a use on June 3, but <br />rather may restrict that call to less than 12 hours. However, the Division Engineer may <br />honor a full 12 -hour call for the following day (call on June 3 for June 4) if there is a <br />reasonable basis to believe that the RICD water right will be beneficially used. <br />• 4.0.3 Measuring Devices <br />
