Board Attorney John McClow said that this discussion constitutes <br />attorney - client privileged communication pursuant to §24- 6- 402(4)(b) <br />and §24- 6- 402(4)(e) C.R.S. <br />Diane Lothamer moved and Bill Trampe seconded that the board <br />adjourn into executive session to discuss matters relating to a <br />possible stay in litigation in the Black Canyon case, a potential <br />agreement with the UVWUA , the District's proposed RICD water <br />right application, and a proposed Memorandum of Agreement with <br />Gunnison County. The motion carried. <br />Board President Greg Peterson reconvened the regular session. <br />Ken Spann moved to approve the proposed stipulated stay <br />conditions for a stay of litigation in the Black Canyon case <br />submitted by John McClow, for execution by the President and for <br />distribution by legal counsel. Dennis Steckel seconded the motion. <br />The motion carried. <br />22.
