John McClow discussed the February 11, 2002 letter to Gunnison County from The <br />Land and Water Fund of the Rockies, urging the County not to sign a proposed <br />stipulation in the Black Canyon case, and a draft response dated February 25, 2002. <br />The manager introduced Michael Dale from the National Park Service, Curecanti <br />Recreation Area. <br />Bob Drexel moved to send the response letter to the Gunnison County <br />Commissioners as drafted. Bob Irby seconded the motion. <br />The manager said that she wants to check on an item in the letter before sending it. <br />Bob Drexel agreed. <br />The motion carried. <br />2b. RECREATIONAL IN- CHANNEL DIVERSION APPLICATION <br />The board discussed the February 21, 2002 letter to the Gunnison County <br />Commissioners from Bob Willey and Gerald Lain regarding the potential for an icing <br />problem on the Gunnison River if the Whitewater Park is built. <br />The board discussed an email received from Cindy Covell dated February 25 <br />concerning the Memorandum of Agreement with Gunnison County, which Greg <br />Peterson suggested discussing in executive session at the end of the meeting. <br />The manager said that she attended a portion of Gunnison County's public meeting with <br />Whitewater Park design engineer Gary Lacy, who said that the park's structures would <br />not exacerbate the current icing conditions. Mr. Lacy indicated that the structures <br />would probably need yearly inspection and possible repair. <br />The board discussed waiting to file its water right application for the Whitewater Park <br />until the County has resolved issues regarding design and location of the park, and until <br />the District and the County have signed a Memorandum of Agreement (MOA) regarding <br />the park. <br />Ken Spann moved to delay filing for an recreational in- channel diversion water <br />right until we have a signed MOA approved by Gunnison County and the <br />UGRWCD, said agreement adequately addressing the icing issue and that said <br />filing contemplate flow option 3 (blue line), when said filing is made. Bob Drexel <br />seconded the motion. <br />The board discussed inclusion of a flow regime in the motion and Lee Spann's request <br />for inclusion of 85 cfs in the West Branch in the motion. <br />Ken Spann withdrew the second part of the motion referring to flow option 3. Bob <br />Drexel agreed to the withdrawal. <br />2 <br />
