Board President Greg Peterson called the meeting to order at 7:05 p.m. <br />2. LEGAL MATTERS <br />2a. RECREATI IN- CHANNEL DIVERSION APPLICATION <br />Greg Peterson said that John McClow had to attend a hearing in Denver and <br />was therefore unable to attend tonight's meeting. <br />Dennis Steckel and Ken Spann left the meeting during the discussion of the <br />District's pending Recreational In- Channel Diversion (RICD) application. <br />The manager said that the board will take public information and comment, <br />and discuss this subject further in executive session later in the meeting. <br />Gerald Bullock read a statement written by him, Carl Long, and Craig <br />Bryant, which he submitted for the record: <br />"I am Jerry Bullock, that's Carl Long and that is Craig Bryant. We welcome <br />this opportunity to talk with you this evening. We are three of the twenty - <br />four people who signed the Statement of Opposition to the UGRWCD's <br />water rights request. I'd like to assure you that we are not a group of <br />radicals. WE ARE NEITHER FOR NOR AGAINST THE WHITEWATER PARK. <br />We are a group of concerned citizens, property owners and local residents. <br />As I understand the statute, the UGRWCD "is responsible for acquiring and <br />defending water rights for the benefit of its constituents In spite of being <br />a part of your constituency; in fact, no one from the UGRWCD talked to any <br />of us until we submitted our Statement of Opposition and yet we may be <br />greatly impacted by your actions. 1 understand that you can't call everyone <br />individually and solicit their opinions on various issues; but, if we have <br />water rights that may be affected or if there has been a previously signed <br />agreement negotiated with the UGRWCD - then some notification or face -to- <br />face communication should occur. The fact that we have to file a <br />Statement of Opposition to get your attention makes us feel that you aren't <br />interested or have already made up you mind on the specific issue. Earlier I <br />introduced Carl Long and Craig Bryant. The three of us are the individuals <br />with whom you (or you predecessors) signed a Memorandum of <br />Understanding on this specific issue more than three years ago - and today <br />we wonder what your intentions of honoring that signed agreement are. <br />Another example of an issue where we don't feel we are being heard is the <br />potential ice damage that may occur as a result of the structures that are <br />going to be used to create the Whitewater Park.
