discussed not calling its RICD water right when the Gunnison Tunnel is <br />calling. It then discussed not calling when the Redlands hydropowerwater <br />right is calling, which would be during fall and winter, when the Whitewater <br />Park is not being operated. She asked if the board still wanted to take this <br />position with regard to Redlands. <br />Diane Lothamer moved to include the Redlands call along with our previous <br />inclusion of the Gunnison Tunnel call in the conditions wherein we would not <br />call our our RICD water right. Jim Cochran seconded the motion. The <br />motion carried. <br />213. BLACK CANYON <br />Board attorney John McClow said that the Unites States Department of <br />Justice is circulating a settlement offer. He said that he, Greg Peterson, and <br />Kathleen Curry met with U.S. Department of Justice attorney David Gehlert, <br />Ed Warner of the Bureau of Reclamation, and Chuck Petty of the National <br />Park Service before the November 13 public meeting on the case. The <br />language regarding point two, that the Black Canyon water right would honor <br />the Aspinall Subordination Agreement was discussed. Mr. Gehlert said that <br />the language we submitted has been approved by the United States and they <br />are checking with other opposers, primarily the State of Colorado, to see if <br />they have a problem with it. Wendy Weiss, of the State, has indicated that <br />the State has concerns regarding whether or not the language would be <br />construed to be a " selective subordination." However, John McClow feels <br />that he can adequately address those concerns by speaking with Wendy <br />Weiss. He said that he urged Mr. Gehlert to accomplish this before the <br />December 3, 2002 status conference with the court. He said that he also <br />expressed concerns with point three, regarding the yield of the Aspinall Unit, <br />and also articulated issues that this District would be concerned about <br />reaching settlement of the case. He added that West Slope opposers' <br />counsel will meet next week in Montrose. <br />3. 2003 BUDGET BRIEFING <br />The manager referred to her November 5, 2002 memorandum regarding <br />cloud seeding and said that County Manager John DeVore came to the <br />meeting to discuss this matter. <br />John DeVore said that the County has a letter of intent with North American <br />Weather Consultants in Utah. The projected costs are $85,000 for the first <br />year, $5,000 for a one -time cost of designing the program, and $4,000 for <br />Page 2 of 8 <br />
