GUNNISON COUNTY BOARD OF COMMISSIONERS <br />GUNNISON COUNTY BOARD OF COMMISSIONERS <br />ATTACHMENT TO MINUTES <br />OF RESOLUTION TEXT <br />BOARD OF COUNTY COMMISSIONERS OF GUNNISON COUNTY <br />RESOLUTION NO. 23 SERIES 2003 <br />A RESOLUTION APPROVING THE PRELIMINARY PLAN <br />FOR NORTH COTTONWOOD PARK, LUC 2000 - 57 <br />Page 10 of 17 <br />WHEREAS, Bonanza Development, LLC, represented by Gary Hausler, submitted the Preliminary Plan for <br />Cottonwood Park, a residential subdivision on 15.9 acres north of the City of Gunnison; and <br />WHEREAS, after a review of the application and all information, documentation and testimony related to it, the <br />Gunnison County Planning Commission did, on October 25, 2002 forward a Recommendation of approval of that <br />application with certain findings and conditions; and <br />WHEREAS, the Board conducted a public hearing on the plan February 4, 2003; and <br />WHEREAS, the applicant, in response to comments by the Board of County Commissioners and the public, did, <br />on February 25, 2003, submit a revised plan that significantly responds to those comments by decreasing the <br />density of the proposed development (as depicted on the "Preliminary Plat of North Cottonwood Park Within <br />Section 24, Township 5o North, Range 1 East, N.M.P.M., Gunnison County, Colorado," dated February 24, 2003, <br />prepared by Furey Land Surveying, Inc., and as referenced within a letter from the applicant dated February 24, <br />2003; and <br />WHEREAS, the Board has fully considered the Recommendation of the Planning Commission, public testimony, <br />and the revisions the applicant has made to the plan to respond to public and Board concerns; and based upon <br />that information adopts the following: <br />The Board finds that: <br />1. A weed management control plan has been submitted. <br />2. Inclusion of the lighting restrictions cited within Section 5 -414: C. of the Revised Resolution, as <br />amended, within the protective covenants of this proposed development meets the requirements of <br />both the Former and the Revised Land Use Resolutions, ensures that lights used within this <br />development will be minimized, and therefore generate the least impacts to the existing <br />neighborhood. No additional lighting plan is required to be submitted. <br />3. The existing Ponderosa community public water system is proposed to be expanded and is <br />regulated by the Department's Water Quality Control Division as PWSID # 126618, and design <br />approval of a new system is required. Plans for the new system require approval of the Division. A <br />copy of that approval by the Department is required to be submitted as part of the Final Plan <br />submittal. <br />4. Evidence of easements allowing the construction and location of sewer lines from the development <br />property across adjacent properties to the main collection line have not been delineated nor <br />submitted. Their submittal is required as part of the Final Plan. <br />5. The applicant proposes to relocate the Whipp irrigation ditch, which crosses the northern portion of <br />this parcel. Agreement with all ditch owners to accomplish that action has not yet been submitted. <br />Relocation of the ditch is integral to location of locations of homes and amenities on certain of the <br />single family and manufactured home lots. If such agreement cannot be secured, it is unclear as to <br />whether lot lines and dimensions and /or numbers of lots would require realignment, and so require <br />replat of at least a portion of the current plan. Such discrepancy shall be required to be indicated on <br />the Final Plat. <br />The City of Gunnison has indicated that a written access agreement is required between the City <br />http : / /www.co.gunnison.co.us /BOCC /minutes /20030304mn.html 6/6/2003 <br />
