vi. Whether the application has appropriate limitations upon the time <br />of day, days per month, or seasons during hich the RICD would <br />d <br />be exercised. <br />f. Whether the amount of water sought represents the minimum amount of <br />water necessary to provide a reasonable recreation experience in and on <br />the water. The Board, in making this finding, may consider, but is not <br />limited to, the following factors: <br />i. Whether the amount of water requested is physically and legally <br />available; and, <br />ii. Whether the recreation experience can be accomplished by <br />participants without highly specialized skills. <br />g. Whether the Applicant is or will be diverting, capturing, and controlling <br />water in its natural course or location with physical control structures. <br />The Board, in making this finding, may consider, but is not limited to, the <br />following factors: <br />i. Whether the structures: are permanent structures; span the whole <br />width of the stream; and, are keyed into the banks; <br />ii. Whether the diversion can be adequately measured and <br />administered in priority; and <br />iii. Whether the structures will change the direction of flow of water. <br />7 <br />Additional Information. Pursuant to Section 37- 92- 102(6)(b), the Board is <br />required to make the findings identified in Rule 6 of these Rules within 90 days <br />after the closing date for the filing of statements of opposition.
