DRAFT <br />V. Whether the amounts of water requested in the RICD application <br />are available for appropriation, and with what frequency and <br />duration are the amounts of water requested in the RICD available; <br />vi. Whether the-RICD will affect current flood elevations; and, <br />vii. Other water uses within the reach that may be impacted by the <br />RIM <br />C. <br />% <br />Whether there is access for recreational in- channel use. The Board, in <br />making this finding, may consider, but is not limited to, the following <br />factors: <br />i. The nature and extent of the access required for the activity for <br />which a RICD is being sought; <br />ii. The ownership, leasehold, or other legal interest held by or readily <br />available to the Applicant for purposes of obtaining access; <br />iii. The ability to gain access without materially interfering with the <br />vested property rights of others; and, <br />iv. Any impediments to that access necessary for a reasonable <br />recreational experience in and on the water. <br />Whether the exercise of the RICD would cause material injury to existing <br />ISF water rights. The Board, in making this finding, may consider, but is <br />not limited to, the following factors: <br />1. <br />ii. <br />The nature and extent of the ISF in the subject reach; <br />The timing and duration of the RICD as such may relate to the <br />specific use which is the basis for the ISF; and, <br />01 <br />* I <br />• <br />R <br />
