Upper Gunnison River Water Conservancy District <br />Case No. 02CW038, District Court, Water Division No. 4 <br />recreational in- channel water rights described in the application. Objector CWCB seeks a denial of <br />the application, or a granting of the water rights subject to terms and conditions contained in the <br />CWCB's October 11, 2002 Findings and Recommendations to the water court or such terms and <br />conditions as may otherwise be proposed by the CWCB. <br />VI. IDENTIFICATION OF WITNESSES AND EXHIBITS. <br />A. Witnesses. <br />Attached hereto are separate lists prepared by the Applicant and the State objectors <br />containing the name, address, telephone number and the anticipated length of each witness' <br />testimony, including cross - examination (I) of any person whom the listing party "will call" and (ii) <br />of any person whom the listing party "may call" as a witness at trial. With respect to expert <br />witnesses, the lists indicate whether the opposing party accepts or challenges the qualifications of <br />a witness to testify as an expert as to the opinions expressed. In the case of challenges, the lists are <br />accompanied by a resume setting forth the basis for the expertise of the challenged witness. The <br />River District intends to call as a witness Eric Kuhn, District Manager, who was disclosed by the <br />River District in its C.R.C.P. 26(a)(2) disclosures. <br />B. Exhibits. <br />Attached hereto are separate lists of exhibits prepared by the Applicant and the State <br />objectors including physical evidence which each such the party intends to introduce at trial. The <br />parties will stipulate to the assignment of numerical, alphabetical, or numerical/alphabetical <br />designations for each exhibit. The River District will submit as an exhibit the resume of Mr. Kuhn. <br />Objections, if any, along with the grounds for any such objections, to the authenticity of any <br />exhibit listed on the attachments hereto are noted. Stipulations, if any, to the admissibility of any <br />exhibit listed on the attachments hereto are noted. <br />On or before the trial date, the parties shall provide a set of the documentary exhibits to the <br />court. <br />VII. TRIAL EFFICIENCIES AND OTHER MATTERS. <br />If the anticipated length of the trial changes, the parties shall inform the court. The parties <br />have considered ways in which the use of technology can simplify the case and make it more <br />understandable. <br />A trial management conference via telephone has been scheduled for August 22, 2003 at 1: 00 <br />M <br />7 <br />
