FINDINGS AND RULING OF THE REFEREE AND DECREE OF THE WATER
COURT

This Application for change of use was filed on November 29,2004 and was referred to
the Water Referee for Water Division No.5, in accordance with CR.S. SS 37-92-101, et seq.
All notices required by law of the filing of this Application have been fulfilled and the Referee
has jurisdiction over this Application. No Statements of Opposition were filed in this matter and
the time to do so has expired. On May 13, 2005, the Division Engineer submitted a Summary of
Consultation and the Referee has given it due consideration.
