ENLARGEMENTS MOA
PUEBLO BOARD OF WATER WORKS
C. Participant is a municipal entity that supplies water for all beneficial uses
including municipal purposes, and desires to participate in implementation and
development of the Enlargements in order to obtain storage space for its
nonproject water.
D. Implementation, development, operation and use of the Enlargements shall
comply with applicable provisions of interstate compacts and other state and
federal laws.
E. Implementation and development of the Enlargements will require compliance
with the National Environmental Policy Act ( "NEPA ") and related statutes. The
Enterprise and Participant anticipate that the Bureau of Reclamation, U.S.
Department of the Interior, will serve as the lead agency for environmental
compliance.
F. In order to implement and develop the Enlargements, the Enterprise is negotiating
and intends to enter into a memorandum of understanding ( "MOU") with the
United States, whereby the Enterprise will reimburse the United States for
