ENLARGEMENTS MOA <br /> GENERAL <br /> Participants, to provide guidance specific to implementation and <br /> development of the Enlargements. <br /> 2. The Enterprise will enter into Enlargement Allotment Contracts only with <br /> Enlargements Participants that reimburse their proportionate share of <br /> implementation costs to the Enterprise pursuant to a MOA executed prior <br /> to enactment of the Enlargements Authorizing Legislation. Those entities <br /> executing such a MOA after No . c J.,er+, 2001, will be required to <br /> reimburse appropriate costs, including, but not limited to a proportionate <br /> share of implementation costs, together with interest. Nothing herein shall <br /> preclude the Enterprise from issuing "EWMS Allotment Contracts" as <br /> described in the Implementation Committee Report. <br /> 3. The Enterprise and Participant intend that the additional storage space <br /> made available by Enlargements will be for the exclusive use of the <br /> Enterprise and the Enlargement Participants, except as provided below, <br /> with the Participant entitled to use its allocated portion of such storage in <br /> the amount established by Participant's Enlargement Allotment Contract. <br /> -22- <br />
