ENLARGEMENTS MOA <br /> WEST OF PUEBLO <br /> b. Water stored in the Pueblo Reservoir Enlargement by a third party <br /> pursuant to sublease with Participant shall be subject to spill when <br /> necessary for the Enterprise to use the storage space (after filling <br /> Enterprise Water Management Storage and any vacant Pueblo <br /> Reservoir Enlargement storage space) to store water under the <br /> water right decreed in Case No. 00CW138; provided that for 120 <br /> days after such spill, the Enterprise shall provide the sublessee a <br /> first right to purchase an equivalent amount of water stored <br /> pursuant to the water right decreed in Case No. 00CW138, at the <br /> same rate then in effect for purchase of allocated <br /> Fryingpan- Arkansas Project water. The Enterprise's storage of <br /> water other than the water right decreed in Case No. 00CW138, in <br /> space allotted to Participant, shall be on an if- and -when available <br /> basis when such space is not being used pursuant to Participant's <br /> allotment. These limitations on the Enterprise shall not apply to <br /> the Enterprise's storage of water in Enterprise Water Management <br /> Storage space, nor to storage of water by sublease in the Turquoise <br /> Reservoir Enlargement.
