ENLARGEMENTS MOA <br /> WEST OF PUEBLO <br /> 8. Participant shall not oppose the Enterprise's applications for conditional <br /> water storage rights filed in Case Nos. 00CW 13 8 (Pueblo Reservoir <br /> Enlargement) and 00CW139 (Turquoise Reservoir Enlargement), Water <br /> Court, Water Division No. 2, except as may be provided in any stipulation <br /> executed between the Enterprise and Participant. <br /> 9. Water stored by Participant in the in the enlarged capacity of Pueblo <br /> Reservoir must be legally and physically available under decrees held by <br /> Participant for storage in Pueblo Reservoir or its enlarged capacity. Water <br /> stored by Participant in the enlarged capacity of Turquoise Reservoir must <br /> be legally and physically available under decrees held by Participant for <br /> storage in Turquoise Reservoir or its enlarged capacity. Storage in the <br /> Enlargements shall be subject to any limitations established by the <br /> Enlargements Authorizing Legislation and the Enterprise's master storage <br /> contract with Reclamation, such contract to be subject to consultation with <br /> Participants. Participant shall be solely responsible for any change of <br /> water rights proceeding or other adjudication that may be necessary in <br /> -17- <br /> • <br />
