. <br /> 4 <br /> ENLARGEMENTS MOA <br /> CS -U <br /> 5. The Enterprise and Participant agree that: <br /> (a) Any payment required or permitted to made by Participant under <br /> this Agreement shall be made only from the following sources: <br /> A. For operating and maintenance expenses constituting an <br /> "Operation and Maintenance Expense" (as defined in <br /> Ordinance No. 00 -154 of the City (the "2000A Bond <br /> Ordinance ")), the gross water system revenues received by <br /> Participant (the "Operations Limited Source of Payment "), <br /> which payments shall have priority of payment over <br /> Participant's utility system revenue bonds; and/or <br /> B. For capital requirements, (1) the "Net Pledged Revenues" <br /> (as defined in the 2000A Bond Ordinance) of Participant <br /> remaining after payment of all amounts having priority of <br /> payment from said Net Pledged Revenues under the <br /> ordinances adopted by the Colorado Springs City Council <br /> -27- <br />
