Water Management Storage space) as provided in MOA's with all
Enlargements Participants. Participant's share of costs also shall include a
prorated portion of costs attributable to development of the Enterprise
Water Management Storage space that is to be made available as part of
the Enlargements, reflecting Participant's obligation to fund the
development of an additional 15 percent of storage space over -and -above
storage actually realized by the Participant to develop the Enterprise Water
Management Storage space, as described in the Implementation
Committee Report.
3. Participant represents and warrants that it is an "enterprise" as defined in
Article X, Section 20(2)(d) of the Colorado Constitution, and that it is
authorized to enter into the multiple -fiscal year financial obligations
provided in this MOA, notwithstanding Article X, Section 20(4)(b) of the
Colorado Constitution.
4. Participant agrees to support the development and implementation of any
of the storage components provided for in this MOA, the PSOP Report,
