The amount of
water in the reservoir at the higher elevation is 26,634 acre-feet, so Denver's discretionary
pool is 10,785 acre-feet.

In addition, and despite its sole and exclusive right, Denver agreed to use best efforts to
operate its pool at the reservoir during the recreation season to maintain a minimum level
higher than the Permanent Pool. Except in periods of drought or under circumstances beyond
Denver Water's control, Denver attempts to keep a minimum of 20,000 acre-feet in the
reservoir from May I and August 31 of each year. Denver implemented the requirements in
the Contract and has generally operated the Permanent Pool according to the Contract each
year since the initial fill was obtained.

i The elevaticill!v;'lu~e relati~nships used in thi~ document ~re from the orig;~31 ContracLThe ns.
