<br />Water Supply Partnership Kit <br /> <br />3) Interim Use of M&I Water Sqpulv DISASTER RELIEF. <br />Storage for Irril'ation. Section 931 of WRDA '86 <br />provides that for any reservoir project constructed <br />and operated by the Corps, the ASA(CW) is <br />authorized to allocate storage which was allocated <br />in the project for M&I water supply, and which is <br />not under contraCt, for the interim use for irrigation <br />purposes. These projects and the amount of <br />storage available is shown in Table 1. The cost to <br />you for this storage will be 35 percent of the <br />construction cost and 100 percent of the operation <br />and maintenance expense, repair, replacement, <br />rehabilitation, and reconstruction costs allocated to <br />the storage space being placed under contract. <br />Repayment shall be annualized on a 30-year basis <br />based on the original project construction cost. <br />The interest rate will he the project rate that was in <br />effect at the time of initiation of the project (see <br />Tables 2 and 3). The term of the agreement for <br />this interim use shall not exceed five (5) years. An <br />option for incremental five year extensions is <br />allowed with the basic agreement only if <br />recalculations for annual operation and <br />maintenance, replacements, rehabilitation and <br />reconstruction costs are performed at the end of <br />each five year increment. <br /> <br />8 <br /> <br />EMERGENCY WATER SUPPLY <br /> <br />CLEAN DRINKING WATER. <br /> <br />Public Law 84-99, as amended by Section <br />82 of the Water Resource Development Act of <br />1974, provides the Corps an opportunity to provide <br />emergency supplies of clean water to any locality <br />which the Chief of Engineers frods is confronted <br />with a source of contaminated water causing or <br />likely to cause a substantial threat to the public <br />health and welfare of the inhabitants of the locality. <br />Cost and repayment shall be as the Chief of <br />Engineers detennines to be advisable. Work under <br />this authority requires a request from the governor <br />of the state where the source of water has becOlEc <br />contaminated and is normally limited to 30 days. <br />Loss of water source or supply is not correctable <br />under this authority. <br /> <br />Public Law 88-99 was further amended by <br />the Disaster Relief Act of 1974 Appropriations <br />(Public Law 95-51), to provide the ASA(CW) <br />authority under certain statutory conditions to <br />construct wells and to transport water to farmers, <br />ranchers, and political subdivisions within areas he <br />determines to be drought distressed. A written <br />request for assistance may he made by any farmer, <br />rancher or political subdivision with a distressed <br />area. Corps assistance will only be considered <br />when non-Federal sponsors have exhausted <br />reasonable means for securing necessary water <br />supplies (within the limits of their financial <br />resources) including assistance from other Federal <br />agencies. <br /> <br />RESTRICTIONS. <br /> <br />Evaluation of requests for assistance are to <br />be tempered by the fact that Corps assistance is <br />supplemental to state and local efforts. Long term <br />solutions to water supply problems are the <br />responsibility of state and local interests. These <br />authorities are not to be used to provide drought <br />emergency water assistance in cases where a <br />livestock owner has other options. Assistance can <br />be provided to transport water for consumption by <br />Federally owned equipment with the cost of <br />transportation to be paid by the Corps. Cost of <br />storage of the water, however, is a non-Federal <br />responsibility. Federal assistance can also be <br />provided to construct wells. The Federal cost, <br />however, must be repaid. <br /> <br />DROUGHT CONTINGENCY WATER <br /> <br />AUTHORITY. <br /> <br />Section 6 of the 1944 Flood Control Act <br />(surplus water) provides adequate authority to <br />l'ennit temporary withdrawal of water from Corps <br />projects to supplement normal supplies in time of <br />drought.
