City of Boulder and <br />Colorado Water Conservation Board <br />Case No. 90CW193 <br />Page 22 <br />administration officials shall deliver such water'past intervening <br />water users to the instream flow segment in which the instream flow <br />use will be made by the Board. <br />4.13 Stream losses, if any, incurred between the point that <br />water is left undiverted in the stream or is released to the stream <br />for instream flow use and the downstream point of the stream <br />segment or segments in which the instream flow use is made, as <br />assessed by State water administration officials, shall be borne by <br />the Board. <br />4.14 The Board shall use water available under the subject <br />water rights pursuant to this decree solely to maintain an instream <br />flow not exceeding 0.5. cfs in Segment A described above, an <br />instream flow not exceeding 1.5 cfs in Segment B described above <br />and an instream flow not exceeding 15 cfs in Segment C described <br />above. With respect to maintenance of instream flow in Segment C, <br />the Board shall first use water available pursuant to its water <br />rights described in paragraph 1.6 above before using any water <br />available under this decree and the Instream Flow Agreements. <br />V. CHANGE OF WATER RIGHTS TO IRRIGATION USE. <br />5.1 The subject water rights described in paragraphs 2.1 <br />through 2.5, 2.7 and 2.8 above are also proposed to be changed to <br />allow, at Boulder's option, irrigation use to be made by lessees of <br />Boulder once water used for instream flow uses passes the <br />downstream terminus of Segment C of Boulder Creek. Such right to <br />use water for irrigation purposes is reserved to Boulder by the <br />Instream Flow Agreements. Only water which is actually used by the <br />Board in accordance with this decree will be available for lease. <br />5.2 The ditches to which water is proposed to be delivered <br />pursuant to leases with Boulder are existing ditches with their own <br />decreed water rights which currently lease water from Boulder that <br />is available to Boulder from other sources. These ditches are <br />described as follows: <br />A. Leggett Ditch: <br />The decreed point of diversion for the Leggett <br />Ditch is on the north bank of Boulder Creek in the <br />NEB SEk SEk of Section 18, Township 1 North, <br />Range 69 West of the 6th P.M.; the location of the <br />actual point of diversion for the Leggett Ditch is <br />approximately 1,875 feet south and 188 feet west of <br />the NEk of Section 18, Township 1 North, Range 69 <br />West of the 6th P.M. <br />22 <br />
